Popular local burger eatery Lions Tap has reached a settlement with McDonald's Corp. over the hamburger giant's use of the slogan "Who's Your Patty" in a multimillion-dollar advertising campaign for Angus burgers.
In documents filed in federal court today, the Eden Prairie restaurant withdraws its suit, which asked for a financial judgment and McDonald's to quit using Lions Tap's trademarked phrase in all advertising.
Bonnie Notermann, a Shakopee resident who has owned the restaurant with her husband Bert since 1977, said she couldn't disclose the terms of the settlement.
"It's a mutually beneficial resolution," she said, " amicable to both sides."
Notermann couldn't say whether McDonald's was required to drop the slogan in its advertising, but said people will be able to draw an assumption of what happened.
The restaurant, located along old Highway 212, acquired a Minnesota patent for the phrase and filed a federal patent application shortly before it filed its lawsuit in late August.
Lions Tap began using the logo in 2005, developing it with the intention of using it in franchising,
Asked if she's happy with the terms of the lawsuit, Notermann said: "I'm happy it's done."
Lions Tap is still working to establish franchises, but nothing is ready to launch yet, she said.
